The franchise is for the establishment and operation of restaurants featuring fondue and offering a wide variety of Foods, including required alcoholic beverages, under the MELTING POT trade name and business system (a "MELTING POT® Restaurant" or "Restaurant"). The franchisee will offer for sale and serve food items, including cheese fondue, chocolate fondue and meat fondue entrees, salads, beverages (including wine, beer and cocktails) and other menu items as the franchisor may from time to time approve in its sole discretion. The franchisee will use the MELTING POT® trade name, logos and service marks (the "Marks") only in strict compliance with the terms of the franchise agreement and applicable law. The franchisee must offer all of the food items, services and amenities approved by the franchisor from time to time for sale at each MELTING POT® Restaurant. The franchisee will operate each Restaurant in strict compliance with the standards and procedures specified in manuals and other materials provided by the franchisor (the "Manuals"). The Manuals cover, among other things, restaurant design and layout, methods of operation, product specifications, service standards, etc. The Melting Pot is based in Tampa, FL.
